Estate Planning

Everything you own is part of your estate.  It is important to plan for the future before it’s too late.  An estate plan ensures that your wishes are followed when it comes to your well-being, both medically and financially.  If you do not have a will that sets forth your wishes for passing on your property, Texas has an intestacy statute that directs your property to be evenly distributed to your heirs.  Rather than allow the state direct how your property is to be distributed, I can help you plan for your future in creating a personalized estate plan to ensure that you and your property are cared for in accordance with your wishes.

Every estate plan with Law Offices of Nathan Peters, PLLC includes a will, a Declaration of Guardian for Self and (if applicable) your Minor Children, a Financial Power of Attorney, a Medical Power of Attorney, and an Advance Directive to Physicians.

The Will - details your wishes for how your property is to be distributed after your death and appoints an executor to probate the will.

Declaration of Guardian for Self and Minor Children - allows you to choose in advance who the Court should appoint as your guardian should some unexpected events occur that cannot be handled by the Power of Attorney and allows you to nominate someone to act as guardian for your minor children should you pass away prior to the children reaching the age of eighteen.

Financial Power of Attorney - allows you to appoint a representative as a legal agent in financial matters and control your estate during your lifetime.  You can limit or expand the powers of your legal agent, and you can make the Power of Attorney effective immediately or only upon your subsequent incapacity.

Medicaid Power of Attorney - allows you to designate a representative to make medical and care decisions for you when you are unable to make informed decisions for yourself.

Advance Directive to Physicians - allows you to specifically state your wishes with respect to going on life support, palliative care, and other available options in the event you are unable to make a decision for yourself and you are diagnosed with a terminal condition.
